Terms of service

Version 2026-10-04-draft · Last updated 4 October 2026

These terms are an agreement between you and emailservicesolutions ("we", "us"). By creating an account or using the service you agree to them and to the Acceptable Use Policy and Privacy Policy.

1. The service

We provide tools for email infrastructure and deliverability control: installing and configuring PowerMTA on servers you control, generating and checking DNS authentication records, SMTP and blacklist testing and monitoring, and email address validation. We do not send email for you, and the service has no tools for composing messages or sending to lists. Your own servers send your mail.

2. Your account

  • An account belongs to one person. You must be at least 18 and able to enter a binding agreement.
  • Keep your password and two-factor authentication safe. You are responsible for activity under your account.
  • Give us accurate information. We may ask you to verify your email address, phone number and business details before some features are available.

3. Your servers and credentials

You may connect only servers and accounts you own or are authorised to administer. When you give us a server login:

  • We log in with the credentials you give us, run our own scripts in a temporary folder with a random name, download the licensed package from our servers, install and configure PowerMTA, and delete the temporary folder and the installer files when we finish or fail.
  • What stays on your server is the PowerMTA installation itself, listed in an install manifest. We never leave a persistent agent, scheduled job or callback on your server.
  • If you let us keep a password, we store it encrypted and decrypt it only inside our workers to perform an action you asked for. Each use is logged and visible to you.
  • You are responsible for backups of your servers and for the effect of the changes you ask us to make.

4. Third-party software

PowerMTA is third-party software. [Licence terms for third-party software to be confirmed by counsel before launch.] We never modify the vendor's packages.

5. Plans, payment and credits

  • Plans are prepaid for the period you choose and are paid in cryptocurrency through our payment processor. Nothing renews automatically.
  • Prices, limits and included credits are shown on the pricing page and may change for future periods. A change does not affect a period you have already paid for.
  • An install that fails does not use an install credit.
  • If a period ends without payment, a short grace period applies and your account then moves to the free plan's limits. We do not delete what you created at once, but you cannot add more than the free plan allows.
  • Refunds are described in the Refund Policy.

6. Acceptable use

You must follow the Acceptable Use Policy. In particular you must not use the service to send unsolicited bulk email, to validate purchased or scraped lists, or to attack, probe or abuse any third party.

7. Suspension and termination

We may warn, restrict, suspend or terminate an account that breaks these terms or the Acceptable Use Policy, that we reasonably believe is being used for abuse, or that puts our infrastructure or other customers at risk. Where we can, we tell you why and which clause applies. You may close your account at any time.

8. Your data

You keep your data. We process it to provide the service, as described in the Privacy Policy and, where we act as your processor, the Data Processing Addendum.

9. Availability and changes

We work to keep the service available but do not promise uninterrupted operation. We may change or retire features with reasonable notice where we can. Planned maintenance and incidents are announced on the status page.

10. Disclaimers and liability

The service is provided "as is". We do not promise that mail will reach any inbox, that a blacklist will delist you, or that a result from a check will stay correct after the moment it was made. [Limitation of liability, indemnity, governing law and venue to be drafted by counsel.]

11. Changes to these terms

If we change these terms we will tell you before the change applies to you, and the new version number will be recorded when you accept it.
